The eviction and foreclosure protections under New York’s Hardship Declaration stay have been extended to January 15, 2022. However, plaintiffs and petitioners may now challenge the validity of the alleged hardship in court. The new legislation notes that the submission of a hardship declaration creates “a rebuttable presumption” that the individual has experienced a COVID-related hardship.
